The video drew a stinging public rebuke from Tricia McLaughlin, Assistant Secretary of the Department of Homeland Security (DHS). In a post on X, McLaughlin expressed outrage that the agency remains under a judicial gag order while Abrego Garcia is free to use social media as a “megaphone.” She was heard stating, “So we, at DHS, are under gag order by an activist judge and Kilmar Abrego Garcia is making TikToks. American justice ceases to function when its arbiters silence law enforcement.” The agency has long alleged that Abrego Garcia has ties to MS-13, a claim he and his attorneys vehemently deny.

The legal friction stems from orders issued by U.S. District Judge Paula Xinis, who has restricted the Trump administration from publicly disparaging Abrego Garcia to ensure his right to a fair trial.
